These Terms of Service (“Terms”) govern your use of gistrel.com (the “Site”) and Gistrel, a personal reading assistant (the “Service”), provided by DevMind Consulting LLC (“DevMind”, “we”, “us”). By using the Site or the Service, you agree to these Terms. If you do not agree, do not use them.
1. Eligibility and accounts
You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. You sign in with a Google or X account and are responsible for activity under your Gistrel account. Tell us promptly at contact@devmind.llc if you believe your account has been accessed without permission.
2. Early access
Gistrel is in early access. Features may change, be limited, or be removed, and the Service may be unavailable at times. We may limit who can use the Service while it is in early access.
3. Connected services
Gistrel works with services you connect, such as X and Google, and with public content from sites such as Hacker News and YouTube. Your use of those services remains governed by their own terms, including the X Terms of Service, the Google Terms of Service and the YouTube Terms of Service. We are not responsible for those services, and their availability or API changes may affect what Gistrel can do. Gistrel is not affiliated with or endorsed by X, Google, YouTube or Y Combinator.
4. Your content
You keep all rights to the notes, collections and other material you create in Gistrel and to anything you send it (“Your Content”). You grant DevMind a limited license to host, copy, process, analyze and display Your Content, and the third-party content you ask Gistrel to collect, only as needed to provide and improve the Service for you. This license ends when you delete the content or your account, except for copies we must keep by law.
You are responsible for having the right to send content to the Service. Third-party content remains the property of its owners; Gistrel stores it for your personal reference and analysis and links back to the original source.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to infringe others’ rights;
- use the Service to republish or redistribute third-party content at scale, or to circumvent another service’s terms or access controls;
- attempt to disrupt the Service, gain unauthorized access to it, probe or scrape it, or reverse engineer it except as permitted by law;
- share your account, or resell or provide the Service to others without our written permission.
6. AI-generated output
Gistrel uses AI models to summarize, assess and explain content. Output can be incomplete, outdated or wrong, including assessments of what is new, true, or worth your time. Gistrel shows the sources behind its assessments; check them before relying on output for important decisions. Output is not professional, financial, legal or medical advice.
7. Fees
Early access is free. If we introduce paid plans, we will tell you the price and terms in advance, and you will not be charged unless you agree.
8. Intellectual property
The Site, the Service and their software, design, text, graphics and logos are owned by DevMind or its licensors and are protected by intellectual property laws. Gistrel and the Gistrel logo are marks of DevMind Consulting LLC. All other trademarks belong to their respective owners. These Terms do not grant you any right to use our marks.
9. Feedback
If you send us ideas or suggestions, you allow us to use them to improve Gistrel without any obligation to you. Thank you, we read all of it.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service; where reasonable, we will give notice and a chance to export your notes and collections. Sections 4 (as to retained copies), 8, 9, 11, 12 and 13 survive termination.
11. Disclaimers
The Site and the Service are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that it will collect every item from a connected source.
12. Limitation of liability
To the fullest extent permitted by law, DevMind will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising from your use of the Site or the Service. Our total liability for any claim relating to the Site or the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or US $50, whichever is greater.
13. Governing law
These Terms are governed by the laws of the United States and of the state in which DevMind Consulting LLC is organized, without regard to conflict-of-law rules. Nothing in these Terms limits rights you have under the consumer protection laws of your country of residence.
14. Changes
We may update these Terms as Gistrel develops. The “Last updated” date above shows when they last changed. We will notify signed-in users of material changes before they take effect. Continuing to use the Service after that means you accept the updated Terms.
